In recent years, foreign direct investment (FDI) has been regarded as one of the key drivers of the Vietnamese economy and assisted Vietnam in upgrading its Global Value Chain participation. In addition to the efforts to promote foreign investment, the Vietnamese government has also implemented policies and development strategies to support and accompany Vietnamese businesses to expand into the international market. As of April 20, 2024, Vietnam has 1,733 overseas investment projects still in effect with a gross investment of over USD 22.22 billion; in which, the investment is concentrated in the wholesale and retail sectors (accounting for 39.4%), real estate activities (accounting for 21.5%) and construction (accounting for 20%)2. The increase in overseas investment has affirmed Vietnam as a dynamic and proactive economic region with deep economic integration while promoting economic cooperation in particular as well as sociopolitical and diplomatic relations between Vietnam and host nations in general. 

With the aims to create a forum that sets its primary focus on investors and enterprises, to address their concerns reaching out to foreign market as well as promoting the use of arbitration as a method of dispute resolution, and facilitate cross-border trade and investment, Vietnam International Arbitration Centre (VIAC), with technical assistant from United States Agency for International Development (USAID), organizes VIAC SYMPOSIUM 2024. VIAC SYMPOSIUM 2024 is themed: “Cross-border trade and investment in times of economic uncertainty: Dispute and Arbitration” to examine current economic fluctuations and discuss appropriate measures to overcome such obstacles. This forum is expected to bring together experienced ADR experts and practitioners, as well as foreign and domestic investors and enterprises who are participating in Vietnam's dynamic and competitive trade and investment market.

Dr. Vu Tien Loc 

Dr. Loc was a famous economist and speaker in Vietnam before becoming President of the Vietnam International Arbitration Centre (VIAC). He is an inventive thinker with overall macro-perspectives, practical and creative approaches.

Chairman & President of Vietnam International Arbitration Centre (VIAC), Deputy cum Member of Economic Committee at Vietnam National Assembly 

Dr. Loc has made significant contributions to the reform, integration, and remuneration of Vietnam's business and investment environment. At the same time, he is actively involved in promoting free trade agreements, trade promotion activities, and largescale investment at the national level, helping to bring many foreign investment projects to Vietnam and promoting Vietnam's exports abroad, guiding and supporting Vietnamese enterprises and business associations in their international integration.

In addition, Dr. Loc has hosted a number of forums, policy dialogues between the government and enterprise, summits, and important business forums in Vietnam and overseas, with the participation of heads of state, scientists, and top CEOs. In 2006 and 2017, he served as Chairman of the APEC Business Leaders' Summit (APEC CEO Summit).

Mr. Vu Anh Duong

As the Secretary General of VIAC, Duong Vu is in charge of supervising all arbitrations administering activities at VIAC, ensuring the efficiency, compliance, and integrity of the procedures under the VIAC Rules.

In particular, Duong has given lectures on commercial arbitration and contract at a number of law schools and training institutions such as the Judicial Academy, VCCI, the Vietnam Bar Federation, etc. In the capacity of an arbitrator, Duong has served in numerous arbitrations in different roles, either co-arbitrator, sole arbitration or presiding arbitrator. His participation concerns diverse areas of dispute, including sales of goods, construction, insurance, leasing, etc.

Mr Duong has been actively participating in various activities to promote the development of arbitration and ADR in Vietnam. Further, with his practical experiences, Duong has been positively contributing to the law-making process, especially those in the field of arbitration and ADRs. Duong was a member of the Drafting Boards and Editorial Teams of many fundamental laws and rules such as the 2003 Ordinance on Commercial Arbitration, the 2010 Law on Commercial Arbitration, the 2015 Decree on Commercial Mediation, the 2015 Civil Code, VIAC’s Rules version of 2004, 2012 & 2017, VMC's Rules of Mediation, Arbitrator's Code of Ethics etc. In addition to practice, Duong also devotes himself to education activities

Pham Duy Nghia

Assoc. Dr. Pham Duy Nghia is a leading scholar of law and governance in Vietnam. He teaches Law and Governance, Public Policy and its Research Methodology. He has been a lecturer who is major in Economics at Fulbright University since 2009. In 2017, he was invited to participate in Case Law Advisory Council including 12 members by the Supreme People’s Court. He had been a head of department of business law at School of Law, Vietnam National University before. After that, he had become the dean of faculty of law at University of Economics Ho Chi Minh City. During the transformation of FETP into the Fulbright School of Public Policy and Management – Fulbright University Vietnam, he was an promoter of establishing the Leadership and Management Program – a new major which it has begun enrolling since 2018

He is also the author of numerous textbooks and scientific publications on legal and administrative issues. One of his studies focuses on effective governance including the way to increase citizen participation in making policy as well as the way to improve efficiency, government transparency and accountability. Assoc., PhD. Pham Duy Nghia has many analysis and regular comments on famous Vietnamese newspapers and mass media on topics such as basic rights of citizens, voice, etc. and accountability in governance, institutional quality, the rule of law and access to justice. He is a Bachelor and Doctor of Law at Leipzig (German). He is also a Fulbright school at School of Law, Harvard University and PhD student at Stanford University.

Dr. Dang Xuan Hop 

Senior Lecturer in Investment and Disputes at Melbourne Law School, University of Melbourne (Australia), VIAC’s Listed Arbitrator

Hop Dang is an arbitrator and academic based Australia. Before setting up Hop Dang’s Chambers in Hanoi, he was a partner at Allens for many years with a strong practice in cross-border infrastructure projects and international commercial arbitration. He advised the Vietnamese Government in drafting the Law on Commercial Arbitration 2010 and has acted as arbitrator in many cases at the Singapore International Arbitration Centre, the Swedish Chamber of Commerce, the Vietnam International Arbitration Centre, the ICC, the Finland Arbitration Institute and elsewhere. He has taught in law schools in Vietnam, Singapore, Japan, Australia and China. He holds law degrees from both Vietnam and Australia and wrote his doctoral thesis at the University of Oxford on the choice of international law in state contracts.

Mr. Nguyen Manh Dzung is founding chairman of Dzungsrt&Associates LLC. He has over 30 years of experience in the settlement of maritime, commercial and investment disputes through domestic litigation and international arbitration.

His practice areas include admiralty and maritime law, arbitration, dispute resolution & mediation, commercial law, contracts, insurance and reinsurance, international law, international trade, litigation and transportation. He has become a full-time arbitrator and is listed on various panels of arbitrators of VIAC (Vietnam), KCAB International (South Korea), HIAC and SHAC (China) and HKIAC (Hong Kong). He is the first Vietnamese Member of the ICC Court of international arbitration and ICC Taskforce on ADR and Arbitration.

He has regularly been appointed as co-arbitrator and presiding arbitrator in various arbitrations on international sale contracts, service contracts, shipping agency contracts, consultancy and design contracts, business co-operative agreements, supply contracts, joint venture contracts, marine insurance policies, M&A transactions, supply chain and logistic service contracts, leasing contracts, partnership agreements, contracts of carriage of goods by sea, loan agreements, etc. under different arbitration rules.

Mr. Victor Smith 

BSc DipArb DipIArb LLM FCIArb, Chartered Arbitrator

Victor began his career in the construction industry as a Quantity Surveyor in England in 1975.He became a Fellow of the Royal Institution of Chartered Surveyors in 1996 and a Fellow of the Chartered Institute of Building in 1999. He has been engaged as a Chartered Quantity Surveyor on a wide range of construction and infrastructure projects in England, Saudi Arabia, France, Nigeria, Dubai, Qatar, Laos and Thailand.

Since 1991 Victor has been based in Bangkok, Thailand. He has been practicing as an independent arbitrator since 2000. He became a Fellow of the Chartered Institute of Arbitrators in 2001 and a Chartered Arbitrator in 2003. He obtained his Master’s Degree in International Commercial Law in 2007.
Victor is the past Chairman of the Thailand Branch of the Chartered Institute of Arbitrators (2019 to 2021), past Chairman of the Commission on Arbitration & ADR for ICC Thailand (2004 to 2012 and 2017 to 2019) and past Thailand Country Representative for the Dispute Resolution Board Foundation (2005). He taught Arbitration & ADR for the Master of Laws Course in Business Law at Thammasat University (2010 to 2014).

Victor regularly sits as an arbitrator and advises parties on arbitration matters. To date he has received over 100 appointments to act as an arbitrator or party representative in various jurisdictions throughout Southeast Asia. Since 2000 he has conducted arbitrations under ICC, HKIAC, SIAC, TAI, VIAC and UNCITRAL arbitration rules under English, Malaysian, Nepalese, Singaporean, Thai and Vietnamese law. Many of the arbitrations he has been involved with have been construction or construction related disputes.

Ms. Athita Komindr 

Head of the UNCITRAL Regional Centre for Asia and the Pacific (UNCITRAL RCAP) 

Athita is Head of the UNCITRAL Regional Centre for Asia and the Pacific (UNCITRAL RCAP), managing technical assistance and capacity building programming available to over 50 States in Asia and the Pacific in key areas of commercial law, including dispute resolution, MSMEs, international contract practices, sale of goods, electronic commerce, transport, insolvency, international payments, secured transactions, and procurement. In that capacity, she coordinates with Governments and international and regional organizations with respect to trade law reform activities aimed at achieving the Sustainable Development Goals.

Athita has over two decades of experience in the fields of international trade and economic law, arbitration, multilateral dispute resolution, and the rule of law and development. Prior to joining the United Nations, Athita mainly advised and worked with numerous Thai agencies, including the Thailand Institute of Justice, the Thai Ministry of Science and Technology, and the Thailand Arbitration Center where she managed the Arbitration and Legal Affairs Divisions. She also worked for the Thai Ministry of Commerce in Bangkok (2002-2005) and Geneva (2005-2010), representing Thailand in bilateral, regional, and multilateral trade negotiations, WTO dispute settlement, and treaty drafting. Admitted to the New York Bar since 2002, Athita has experience in both common and civil law traditions in the public and private sectors, and holds degrees from Harvard College, Georgetown University Law Center, and Harvard Law School.

Ms. Nguyen Thi Mai

Ms. Mai Nguyen has worked for the Ministry of Justice for 30 years of which 10 years she has acted as a deputy director of Judicial Support Department. Now she holds the position of Secretary General of the Vietnam Bar Federation. She has played an active role in drafting legislation such as Law on Lawyers, Law on Commercial Arbitration, Law on Public Notary, Bankruptcy Law, and a number of sub-law regulations falling into the competence of the Ministry of Justice. She has also participated in management of a number of ODA projects including DANIDA, JPP, USAID - funded projects, etc. She has drafted some guides on employment laws of Vietnam. She is an author of articles and speaker on commercial arbitration, mediation, auction and legal practice in Vietnam. In her position, she has chaired and participated in many international and local and international workshops on commercial arbitration and mediation.

Mr. Dau Anh Tuan 

Vice Secretary-General cum Director of Legal Department at Vietnam Chamber of Commerce and Industry (VCCI), VIAC’s Listed Arbitrator

Mr. Dau Anh Tuan is a Member of the Standing Committee, Vice Secretary-General of the Vietnam Chamber of Commerce and Industry (VCCI), the largest national organization representing the Vietnamese business community. From 2012 to date, Mr. Tuan has served as Director of the Legal Department, responsible for the operations and development of the unit specializing in policy, law, and business environment reform of VCCI. With 20 years plus working in the Legal Department of VCCI, of which 10 years in the position of Director, Mr. Tuan has extensive experience in business-related policy and legal issues. Mr. Tuan directly participates in the drafting committee, the editorial team and the working group for the implementation of many important laws related to enterprises such as the Enterprise Law, Investment Law, Land Law, Securities Law, etc. and other laws, decrees, and circulars governing enterprises and business activities. Mr. Tuan has directly engaged in counselling, dispute settlement, protection of interests of industries and domestic and foreign enterprises and has participated in many particularly complicated and sensitive cases.

Vu Thi Chau Quynh

Deputy Director General, Department of Legislation, Ministry of Planning & Investment, VIAC’s Listed Arbitrator

Ms. Vu Thi Chau Quynh is the Deputy Director General of the Department of Legislation at Ministry of Planning & Investment. She is also one of VIAC's Listed Arbitrators. She received her LL.M. at University of San Diego, USA and MBA at National Economics University, Vietnam. She specializes in Investment law, Investor - State Dispute settlement. During her time working at the Department of Legislation at Ministry of Planning & Investment, Ms. Quynh has had the opportunity to participate in vital legal activities, such as dispute settlement and implement the provisions on investment from different treaties, free trade agreements. She has helped protect the inherent rights of Vietnam in disputes with foreign investors, of the State in international arbitration in accordance with UNCITRAL and ICSID arbitration rules. She has contributed to establishing legal documents related to business investment, such as Investment Law, Enterprise Law, Land Law, Real Estate Trading Law, Housing Law, etc. and other documents that provide guidance on implementation.

Tran Viet Dung  

Vice Rector of HCMC Law University, VIAC’s Listed Arbitrator

Dr. Tran Viet Dung is Assoc. Professor, Dean of International Law Faculty, Ho Chi Minh City University of Law (HCMUL). He also teaches LLM Programmes of the University of West England, Jean Moulin University Law School, Montesquieu University of Bordeaux, Chulalongkorn University; member of the BOM of DILA Foundation; member of Editorial Board of the ASEAN Journal of Legal Studies and Vietnamese Journal of Legal Sciences. He is also senior research fellow of Tallinn Technology University. His research focus is international investment, international trade, M&A, ISDS, investment and sustainable development, technology and law. Dr. Dung combines academic knowledge with practical experience as an international lawyer. He has practiced law in Singapore for almost 7 years at the top-tier law firms, namely WongPartnership and KhattarWong. He is the founder of and currently senior consultant of DL & Partners. Dr. Dung experience covers foreign investment, commercial transactions, employment, international trade, renewable energy and construction for both dispute settlement and transaction work. He wrote and published many articles and books in the area of international trade, international investment, international competition, international arbitration, law and technology.

Ms.
Nguyen Thi Minh Hue 

Director of the Center for International Commercial Law Training, Judicial Academy

Ms. Huệ serves as the Director of the Cooperation Center for Lawyer Training on International Law, Judicial Academy, Ministry of Justice, Vietnam. Since 2006, she has played a vital role in the design, delivery, and management of numerous training programs for legal trainees, practicing lawyers, and other legal professionals in Vietnam. She has made significant contributions to the Lawyer Training Program for International Integration, which encompasses comprehensive modules on lawyer skills in resolving disputes through commercial arbitration. Ms. Huệ has been the chief editor and co-editor of several authoritative textbooks, teaching materials, and reference manuals on professional skill development for lawyers in Vietnam.

Between 2013 and 2014, Ms. Huệ conducted advanced research on legal education at Harvard Law School. Her scholarly pursuits extend to ongoing research on skills training and professional ethics for lawyers, arbitrators, and mediators in jurisdictions including the United Kingdom, Australia, Canada, Singapore, Japan, and South Korea. She has actively participated in numerous high-profile projects led by the Ministry of Justice of Vietnam, USAID, JUDGE, the EU, RITZ, and KOICA, which are dedicated to judicial reform and the enhancement of national capacities in legal training and development.

Ms. Huệ is also a Mediator at the Vietnam International Commercial Mediation Center (VICMC) and a distinguished Member of the Vietnam National Committee of the ASEAN Law Association.

Le Vu Nam 

Vice Principal at University of Economics – Law, Vietnam National University HoChiMinh City, VIAC’s Listed Arbitrator

Mr. Nam has more than 25 years of experience in teaching and legal consulting on businesses, finance - banking - tax, and securities. He conducted many studies on Vietnam’s judicial system with a number of typical studies published domestically and internationally, such as Improving the law on corporate governance listed on the stock market. In Vietnam (2014-2016), Vietnam Financial Market Annual Report 2015: Background of joining the ASEAN Economic Community (2015), Integration of Vietnam’s stock market within the framework of the Economic Community ASEAN (2016), Some inadequacies in the regulations on information disclosure of listed companies and recommendations for completion (2017), Law on corporate governance listed on Vietnam’s stock market (2017) ), Virtual money and the issue of building legal framework for managing virtual currencies in Vietnam (2019), etc. Mr. Nam also participated in developing, commenting or assessing the impact of many laws in Vietnam, such as the Enterprise Law, the Securities Law, etc.

Truong Nhat Quang, the Managing Partner of YKVN, heads a well-recognized, top tier corporate practice focused on banking, capital markets and M&A transactions.
Quang has successfully handled landmark M&A deals in Vietnam, regularly advising on complex lending and borrowing issues as well as representing government agencies and multilateral organizations on nation-shaping industrial projects. Quang’s clients include top Vietnamese banks and corporates, global investment banks, banks active in Vietnam and global private equity funds.
He is the respected author of numerous publications on Vietnam’s legal environment and has co-authored articles specifically on banking and project finance in the country, such as the Vietnamese chapter of Banking Yearbook 2004 (International Financial Law Review, 2004), “BOT Project Financing in Vietnam” (Asia Law, 2003), and the Vietnamese chapter of “Taking Security in Emerging Asian Markets” (Asia Law, 1997).
In particular, Quang has authored the treatise on Vietnamese corporate law “Corporate Law – Fundamental Legal Issues” (Pháp Luật Doanh Nghiệp – Các Vấn Đề Pháp Lý Cơ Bản) and “Skills for Transactional Business Lawyers – Sharing Real Life Experience in Vietnam” (Kỹ Năng Hành Nghề Luật Sư Tư Vấn – Chia Sẻ Kinh Nghiệm Hành Nghề Thực Tế Tại Việt Nam).

With more than 18 years of experience as a lecturer at Foreign Trade University, Mr. Bao is currently the dean in charge of the Faculty of Law. As a well-trained person in the field of law and business from bachelor to post graduate level, Mr. Bao is very knowledgeable about the operation of Vietnamese enterprises. Mr. Bao's areas of practice and in-depth research on international business and commercial contracts, e-commerce law, Law on finance and banking. He has published many related works in the above fields. Mr. Bao is teaching at many universities in Hanoi such as Vin Uni University, Hanoi University, Hanoi Law University, Diplomatic Academy, Hanoi National University, and National Economics University. He is also a trainer for the CFAB international certificate of the Institute of Chartered Accountants of England & Wales in Vietnam. Nguyen Thi Duyen

Ms. Duyen is an expert in the construction industry, having worked in various fields such as construction contractor, project management - investor, state management, and construction consultancy. With 20 years of experience as a construction contractor, she has held positions from field engineer to site commander, Deputy General Director of Hanoi Construction Corporation. In her role as project manager - contractor, she was the Director of the Construction Bidding Project Management Board for the National Assembly Building and the (new) Ba Dinh Hall under the Ministry of Construction, and invested in the construction of the National Convention Center and the National Assembly Building. In state management (from 2010 to 2012), she was appointed as Director, Deputy Head of Business Innovation and Development Department by the Ministry of Construction. And in the year 2012-2016, she held the position of Chairmwoman of the Member Council of Vietnam Construction Consulting Corporation (VECAS).

Recognized as an experienced expert in the construction industry, Ms. Duyen represents VECAS to take part in and has contributed significantly as a member of the drafting committee for a number of laws and decrees established by the Ministry of Construction and the Ministry of Planning and Investment, such as the Law on Construction, Law on Amending and Supplementing articles of the Law on Construction No. 50/2014, and the newest Law on Bidding. At the same time, she has also represented VECAS as a member of the Appraisal Council for a number of legal documents and decrees related to construction and bidding established by the Ministry of Justice.
In scientific research activities, she has promoted and been the director of 5 ministerial-level scientific and technological tasks with research topics on FIDIC contracts, construction practices in other countries, in order to propose regulations and policies suitable for Vietnam. Ms. Duyen is recognized as a major contributor to the research, establishment of the translation and publication of FIDIC contract templates into Vietnamese and is currently a lecturer in FIDIC contract courses at VECAS.

Lawyer Nguyen Ngoc Minh is the Deputy Director of Dzungsrt & Associates LLC. Mr. Minh is leading a team of six members specializing in international dispute resolution by Arbitration, Litigation and ADR.
